Legal Aid may be available, subject to eligibility, in respect of serious and/or complex motoring offences
Eligibility for Legal Aid in the Magistrates Court involves an Interests of Justice Test and a Means Test, requiring your case to be sufficiently serious or complex, with your income below a certain threshold.
Legal Aid is also available in the Crown Court, where eligibility is based on an Interests of Justice Test and a merits test. Your case must be serious or complex, and your income must fall below a specific threshold for the Legal Aid Agency to cover costs. If granted Legal Aid in the Crown Court, you may need to pay a contribution based on your income. We can discuss your eligibility and assist with the application process.
